1. Who we are
Real Earth Data is operated by Rubio & Berry (ABN 89 790 781 274), a business established in Australia ("we", "us", "our"). You can reach us at www.rubioberry.com or murray@rubioberry.com. By using the site or making a donation you agree to these Terms.
2. The service
Real Earth Data is an interactive, educational visualization of global oxygen and carbon flux. Optional donations ("tips") support ongoing work. There are no accounts, subscriptions, or paid features — tips are one-off, voluntary, and confer no benefits or entitlements.
3. Acceptable use
You agree not to misuse the site, including: unlawful use, fraud, spam, IP infringement, or security interference (malware, scraping, probing, or interfering with normal operation). Full rules are set out in our Acceptable Use Policy, which forms part of these Terms.
4. Intellectual property
All software, visuals, copy, and branding on Real Earth Data are owned by Rubio & Berry. You receive no license to reuse, resell, or redistribute them.
5. Service level
The site is provided "as is". We do not guarantee uninterrupted or error-free operation, and disclaim all implied warranties to the fullest extent permitted by law.
6. Donations and refunds
Donations are voluntary and processed via PayPal. Payment, billing, and dispute mechanics are governed by PayPal's User Agreement. See our Refund Policy.
7. Suspension
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations.
8. Liability
To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid us in the 6 months before the claim. We exclude liability for indirect, consequential, or special damages, except where liability cannot be excluded by law.
9. Governing law
These Terms are governed by the laws of New South Wales, Australia, and the courts of that jurisdiction have non-exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections in your country of residence.
